Donald Trump’s latest attempt to turn the federal courts into his personal complaint box just got a reality check.
The U.S. District Court Judge, Miami, didn’t bother with polite skepticism. She went straight for the jugular, questioning whether Trump’s $10 billion lawsuit against the IRS and Treasury is even constitutional.
“The Court is concerned that the parties may not be sufficiently adverse to satisfy Article III’s requirements,” Williams wrote, slicing through the MAGA legal theater.
Trump, ever the showman conman, claims he’s suing in his “personal capacity,” but the judge wasn’t buying the act.
“President Trump is the sitting President of the United States, and the named Defendants are agencies whose decisions are subject to his direction,” Williams wrote as she dismantled the core premise of the lawsuit with precision.
Translation: You can’t sue yourself and call it justice.
The Evidence: Judge Williams’ Words Leave No Doubt
Williams’ order reads like a masterclass in judicial side-eye. She didn’t just question Trump’s motives - she questioned the very foundation of the lawsuit.
“Federal courts are courts of limited jurisdiction. The Constitution limits the jurisdiction of federal courts to ‘cases’ and ‘controversies,’” Williams wrote.
Judge Williams cut straight to the absurdity. She pointed out the farce of Trump’s dual role, noting,
“The unique dynamic presented by this litigation, where the President is both the plaintiff and, through his control of the executive branch, the ultimate overseer of the defendant agencies, raises substantial questions regarding the existence of a true case or controversy.”
Trump practically handed her the ammunition. He told reporters aboard Air Force One that it was “very interesting” to be on both sides of a lawsuit. He even mused in public that his case would basically require him to settle with himself.
The court used his own arrogant words against him. Williams wrote, “Indeed, President Trump’s own remarks about of this litigation.”
The judge ordered both sides to explain by May 20 whether this is a real lawsuit or just a taxpayer-funded performance, warning,
“The Court cannot proceed unless and until it is satisfied that it has subject matter jurisdiction over this action.”
The Turn: MAGA Hypocrisy Meets Legal Reality
Trump’s legal team wants the world to believe he’s the victim of a deep-state conspiracy, demanding $10 billion because the IRS failed to stop a contractor from leaking his tax returns.
Yet, the judge saw right through the charade. Williams highlighted the “potential conflict of interest” and the constitutional absurdity of a president suing agencies he controls.
She didn’t let the government off the hook either, noting the Attorney General’s “statutory obligation to defend the IRS when it is hailed into court, but then is ostensibly required by executive mandate to adhere to the President’s opinion on a matter of law in such a case.”
Trump’s Executive Order 14215, signed last year, makes that mandate explicit by forbidding any executive branch employee from arguing a legal position in court of the law contrary to his own.
The hypocrisy is staggering: Trump wants to play both victim and boss, hoping the courts will rubber-stamp his grievance. Williams isn’t having it.

The Consequences: Trump’s Lose-Lose and the Court’s Next Move
Williams didn’t just throw shade - she threw a wrench into Trump’s entire strategy. She refused to grant the 90-day delay Trump wanted for “settlement talks,” instead freezing the government’s obligation to respond and setting a hearing for May 27.
Her message was clear: “The Court will not permit the parties to proceed further until the threshold issue of jurisdiction is resolved.”
Trump’s legal circus has finally met a ringmaster who refuses to play along.
